✔️ Recently, the next meeting of the Ukrainian-Polish Mixed Commission on international road transport took place.
According to the Ministry of Communities and Territories Development of Ukraine, the main topics of the meeting included:
◽️ Features and procedures for using the SENT system for transport to and through Polish territory
◽️ Transport “for own needs”
◽️ Permits for transport to/from third countries
◽️ The term of stay for drivers in the territory of the other side.
Serhiy Derkach called on Ukrainian transporters to carefully study the specifics of the Polish electronic registration and monitoring system SENT, registration in which since November 1 of this year has become mandatory for foreign freight transporters traveling to or through Poland, to protect themselves from potential fines 💰
Currently, unfortunately, according to reports from Ukrainian companies, there are cases of UNLAWFUL application of fines to Ukrainian transporters using the e-TOLL system for road payments in Poland. The Polish side assured that they would process all provided cases to prevent such situations in the future.
It is noted that Polish legislation officially provides a procedure for appealing such fines in the event of their illegality.
Also, during the meeting, the issue of cargo transportations carried out by companies for their own needs was raised. The position of the Ukrainian side is to liberalize such transportations, as is the case with other EU countries. In contrast, the Polish side did not support this proposal. The parties continue to work on finding options for resolving this issue ⚖️
In addition, during the meeting, the parties developed a mechanism to resolve the issue of performing cargo transportations to/from third countries. The Ukrainian side has already developed a draft amendment to the bilateral Agreement on road transport between Ukraine and Poland and submitted it to their Polish colleagues.
The amendments to this Agreement proposed by the Ukrainian side include increasing the term of stay for drivers from neighboring countries between Ukraine and Poland.
